We have been informed by the vendors solicitor that it is proposed that:

‘If within the period of 10 years following completion the buyer or the buyer`s successors in title were to dispose of all or part of the 10 metres of land at the end of the garden separately from the remainder of the plot, the buyer or the buyer`s successors in title will pay to the seller or the seller`s successors in title the sum of £30,000. `Disposal` would be defined as including a Transfer of Part and lease and perhaps other forms of disposition. The Transfer to the buyer would include provision for a Deed of Covenant to be entered into by successors in title to continue to create direct contractual relations in this regard between the sellers and the owners for the time being of the plot and in particular the 10 metres of land. A `restriction` will also be imposed on the register of title to enforce the implementation of the overage provisions.
